Pre-sale Policy

This Pre-Sale Policy and any terms expressly incorporated herein (the “Policy”) govern the pre-sale of the devices developed by Horys Global Electronics Trading LLC (“Horys", “we”, “our”, “us”) specifically LK One, xK Computer (500, 1000, 5000, 10,000 and Validator), collectively referred to as the “Devices”.
This Policy explains how the buyer (the “Buyer”, “you” or “your”) may participate in our pre-sale campaign available at http://horystech.com/. You shall read this Policy carefully before placing your order. By placing your Order, you agree to be bound by this Policy and all supplementary agreements, including the Terms and Conditions, Privacy and Cookies Policy, Delivery, Warranty, and Return Policy, and any other subsequent agreement related to the present document.
This Policy may be made available in several languages for educational purposes only. In case of any inconsistency between the English version and a translated version, the English version prevails.
1. TERMS
1.1. A pre-sale is an offer to purchase the Devices, which are not yet available for general sale, through our website.
1.2. In order to place an order during the pre-sale period, you will need to provide certain information, including but not limited to, your name, address and billing information, in order to be eligible. It is your responsibility to ensure this information is accurate and up to date. If we do not have accurate information, we will not be able to keep you informed of the status of your Order, or refund any payments, if applicable.
2. ORDERS
2.1. The Buyer may at any time during the pre-sale, pre-purchase a Device from the retail website (an “Order”).
2.2. An Order shall constitute an offer by the Buyer to purchase the specified Device(s) in accordance with this Policy.
2.3. The offer constituted by an Order shall remain in effect and capable of being accepted by us until the Buyer receives an Order confirmation, which will be sent to the contact details provided at checkout. If the Buyer does not receive an order confirmation within forty-eight (48) hours after placing the order, please contact our support team at
2.4. Horys may accept or reject an Order at its discretion. An Order shall not be accepted, and no binding obligation to supply any Device(s) shall arise, until Hory’s written acceptance of the Order via an Order confirmation.
2.5. Rejection of an Order by Horys, including any communication that may accompany such rejection, shall not constitute a counter-offer capable of acceptance by the Buyer.
2.6. Marketing and other promotional material relating to the Device(s) are illustrative only and do not form part of this Policy. The Buyer agrees that, in submitting an Order, they have not relied on any representations or statements by Horys, other than those expressly set out in this Policy.
3. DELIVERY AND WARRANTY

4. PRICE
4.1. The Buyer understands and acknowledges that the price of each Device is variable, and subject to change at the sole discretion of Horys. Once the Buyer provides the payment and receives the Order confirmation, the price cannot be changed.
4.2. The full amount of the Device will be payable upfront when placing an Order.
4.3. Additional charges may occur as follows:
4.3.1. An activation fee is required in order to participate in the pre-sale, and it will be automatically added to the Order at the checkout.
4.3.2. Additional shipping charges are determined automatically at checkout based on the country you are purchasing from, and subject to change based on geographical location and time of purchase.
4.3.3. Additional Warranty packages are available for an additional fee.
4.3.4. Additional customs duties may be levied contingent upon the jurisdiction to which the product is being dispatched.
5. PAYMENT
5.1. We accept only credit card payment in order to participate in the pre-sale.
5.2. Payments made by credit card are subject to additional fees which will be identified at checkout. You are liable for these additional fees, and these can vary depending on your card issuer.
6. LIMITATION OF LIABILITY
6.1. Horys will supply the Devices in conformity with the Device specification; however, it accepts no liability for any delayed delivery, malfunction, fault, or damage to the Device, except to the extent prohibited by law.
6.2. Regardless of whether we were advised of the possibility of such damages, we do not assume any liability for any special, direct, indirect, incidental, punitive or consequential damages of any kind whatsoever arising from or in connection with the Devices, including but not limited to loss of profits or revenues, loss of data, loss of assets, or otherwise. Our liability for any claim arising out of or related to the Devices shall not exceed the value of the Device, at the time of its loss, regardless of the form of action, whether in contract, tort (including negligence), strict product liability or any other cause of action or legal or equitable theory.
7. FORCE MAJEURE
Horys shall not be held liable if we fail to comply with the terms of this Policy due to circumstances beyond our reasonable control, including but not limited to the provisions outlined in this clause. In no event shall Horys be responsible for inaccuracies, errors, delays, omissions, service disruptions, or interruptions in the delivery of the Devices, when caused as a result of governmental actions, acts of terrorism, war, fires, disruptions in telecommunications or internet services, network provider issues, software malfunctions, network-wide compromises, hacking, strikes, labour disputes, accidents, civil or military disturbances, or other catastrophic events.
