xK Computer Care Policy

1. THE PLAN

1.1. This contract (the “Plan”) governs the services provided by Horys Global Electronics Trading LLC (“Horys”, “we”, “us”, “ours”) for your xK Computer Care Policy plan purchase and includes the terms in this document, your Plan Confirmation (the “Plan Confirmation“), and the original sales receipt for your Plan.

1.2. Your Plan Confirmation will be provided to you at the time of purchase or sent to you automatically thereafter. If you purchased your Plan from Horys, you may obtain a copy of your Plan Confirmation by going to the purchases page on your account.

1.3. Benefits under this Plan are in addition to your rights under applicable laws, and the manufacturer's standard hardware warranty.

1.4. The Plan covers the xK Computer devices listed on your Plan Confirmation (“Covered Device”). The Plan only applies to one device, therefore if you have multiple devices you wish to cover, you must purchase a separate Plan for each device.

1.5. This Plan does not cover the LK One Smartphone.

1.6. Covered Device includes any replacement product provided to you by Horys under this Plan.

1.7. The Plan begins from the date of delivery of the Covered Device, and continues for twelve (12) months, unless cancelled prior (the “Plan Term”). In case the Covered Device is replaced, the Plan does not renew from the issuance of a new device, rather the original date of the delivery of the device will apply.

2. PAYMENT

2.1. The price of the Plan is informed to you at checkout, before completing your order, and is available on the original sales receipt as provided by Horys.

2.2. The Plan can only be purchased during the time of purchase of the Covered Device. The Plan is not available for standalone acquisition or retroactive purchase.

2.3. Horys reserves the right to change the price of the Plan at its sole discretion. In such instances, you will be notified of any changes prior to payment.

2.4. Payment shall be made by either card or cryptocurrency, with the choice of payment method at the sole discretion of the purchaser.

2.5. Horys only accepts cryptocurrency payments made in stablecoins.

2.6. When receiving a payment made by credit card, Horys reserves the right to charge a 5% (five per cent) fee related to the credit card operation costs. There are no payment fees charged by Horys to pay your order by using cryptocurrency.

3. WHAT IS COVERED?

3.1. Hardware Services for Defects (“Hardware Service”): If during the Plan Term, you submit a valid claim by notifying Horys that a defect in materials and workmanship has arisen in the Covered Device, Horys may, at its discretion, either:

  1. Repair the defect remotely by assisting you in actions required;

  2. Repair the defect at no charge, using new parts; or

  3. Exchange the Covered Device with a replacement product that is new or comprises new and/or previously used genuine Horys parts and has been tested and passed Horys functional requirements, subject to additional costs to be borne by you.

  4. If Horys exchanges the Covered Device, the original product becomes Horys’ property and the replacement product is your property, with coverage effective for the remainder of the Plan Term. The Plan term does not renew even if the device is fully replaced. Horys may use Covered Devices or replacement parts for service that are sourced from a country that is different from the country from which the Covered Device or original parts were sourced.

  5. Services for Accidental Damage from Handling (“ADH Service”): if, during the Plan Term, you submit a valid claim by notifying Horys that the Covered Device has broken due to accidental damage from handling resulting from an unexpected and unintentional external event (such as, drops and damage caused by liquid contact) Horys may, at its discretion, either (i) repair the defect using new parts or (ii) exchange the Covered Device with a replacement product that is new or comprised of new and/or previously used genuine Horys parts and has been tested and passed Horys functional requirements, subject to additional costs to be borne by you. These are subject to exceptions as provided for in Clause 4 of this Plan.

4. WHAT IS NOT COVERED?

4.1. Horys may restrict Hardware Service and ADH Services to the country where the Covered Device was originally purchased.

4.2. Horys will not provide Hardware Services or ADH Services in the following circumstances:

4.2.1. To protect against normal wear and tear, or to repair cosmetic damage not affecting the functionality of the Covered Device;

4.2.2. To conduct preventive maintenance;

4.2.3. To replace Covered Device that is lost or stolen;

4.2.4. To repair damage caused by reckless, abusive, wilful or intentional conduct, or any use of the Covered Device in a manner not normal or intended by Horys;

4.2.5. To repair damage caused by a product that is not Covered Device;

4.2.6. To repair any damage to Covered Device (regardless of the cause) if the Covered Device has been opened, serviced, modified, or altered by anyone other than Horys or an authorized representative of Horys;

4.2.7. To repair any damage to the Covered Device with a serial number that has been altered, defaced or removed; or

4.2.8. To repair damages caused by force majeure.

5. MANUFACTURER'S WARRANTY

5.1. Upon purchasing a device from Horys Mall, a standard warranty is provided by Horys, the manufacturer, for a period of one (1) year (“Manufacturer's Warranty”). All customers are advised to read the terms of warranty carefully before purchasing the xK Computer or any additional products available in the platform.

5.2. Customers that have purchased the xK Computer Care Policy Plan, will be entitled to an additional one (1) year of standard warranty upon expiration of their Manufacturer's Warranty.

6. HOW TO OBTAIN SERVICE AND SUPPORT

6.1. You may obtain service or support by referring to the ‘RMA’ tab on the Horys website at: http://horystech.com/.

6.2. As per the RMA Policy, you must provide the full details required in the RMA Form upon request, and present your Plan Confirmation, as well as the original sales receipt for your Covered Device and your Plan.

6.3. If your request cannot be resolved remotely by customer support, you may be required to send your device to our repair centre located in Dubai, United Arab Emirates, for repair or replacement. For policy holders, the shipping cost and fees are included in the price of the policy. In the case of pickup services of the device which requires any reparation, Horys will arrange the service through a third-party logistic partner. Please be aware that you will be responsible for all shipment costs and any additional fees incurred outside of the repair, if required.

7. SERVICE OPTIONS

7.1. Horys will provide hardware services to you through one or more of these options (Repair Services):

  1. Customer Support Remote Resolution: if you have an issue that may be fixed remotely, customer support will use their best efforts to assist you in resolving the problem. Once you contact customer support, they will schedule a time to assist and instruct you on how to try and renew the device from your location.

  2. Mail-In Repair: should your Covered Device not be fixable via option 7.1.1., you may be required to send it to our authorized repair centre. Customer support will provide you with full process and shipping details should this circumstance occur, and we will repair or replace the Covered Device upon evaluation. Please be advised that you will bear responsibility for any supplementary expenses beyond the repair, including shipping costs.

  3. Horys may, at its discretion, either return your Covered Device or provide a replacement if the Device cannot be recovered with some applicable exclusions, as detailed below:

    1. The former clause is not applicable for cases when the device has been tampered by its user.

    2. In case of tampered devices, the user will be liable for shipping and returns, likewise, for any additional costs related to the service centre in connection with the examination of the device.

    3. In the former case, the user is responsible for picking up the device from the service centre, within thirty (30) days from the date of notification sent by Horys to the user, otherwise Horys is not liable for the return of the tempered device.

8. YOUR RESPONSIBILITIES

8.1. To receive service or support under the Plan, you agree to:

8.1.1. Provide your Plan Agreement Number, a copy of your Plan’s original proof of purchase and a copy of the Hardware's purchase receipt;

8.1.2. Provide information about the details and causes of the issues with the Covered Device;

8.1.3. Respond to requests for information needed to diagnose or service the Covered Device;

8.1.4. Follow instructions received by Horys’ support team;

8.1.5. To pay the additional costs outside of the repair and shipping;

8.1.6. Send the Covered Device to the repair centre in good time in order to receive the Repair Services (if mail-in repair is required).

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Horys and its employees and agents will under no circumstances be liable to you or any subsequent owner of the Covered Device for any indirect or consequential damages resulting from Horys’ obligations under this plan. Horys specifically does not warrant that: (i) it will be able to repair or replace the covered device without risk to or loss of programs or data, (ii) it will maintain the confidentiality of data or (iii) the operation of the product will be uninterrupted or error-free. The benefits conferred by this plan are in addition to any rights and remedies provided under consumer laws and regulations. To the extent that liability under such laws and regulations may be limited, Hory’s liability is limited, at its sole option, to the replacement or repair of the covered device or supply of the service.

10. TRANSFER OF PLAN

You are not permitted under any circumstances to make any transfers of rights under this Plan to another party or device.

11. GENERAL TERMS

11.1. Horys may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so.

11.2. Horys is not responsible for any failures or delays in performing under the Plan that are due to events outside of Horys’ reasonable control.

11.3. You are not required to perform preventive maintenance on the Covered Device to receive service under the Plan.

11.4. In carrying out its obligations Horys may, at its discretion and solely for the purposes of monitoring the quality of Hory’s response, record part or all of the calls between you and Horys.

11.5. You agree that any information or data disclosed to Horys under this Plan is not confidential or proprietary to you. Furthermore, you agree that Horys may collect and process data on your behalf when it provides any service. This may include transferring your data to affiliated companies or service providers in accordance with the Horys Privacy and Cookies Policy.

11.6. Horys has security measures, which will protect your data against unauthorized access or disclosure as well as unlawful destruction.

11.7. You understand and agree that by purchasing the Plan, Horys will use, process, transfer, and protect your information in accordance with Horys Privacy and Cookies Policy, available at http://horystech.com/ which is deemed to be incorporated to this Plan by reference.

11.8. Without prejudice to the foregoing, you agree that Horys, its affiliates or service providers may use and process your name, device serial number, contact information, repair history and other personal information we, our affiliates or service providers collect or generate in relation to your purchase and Plan, for the purposes of:

11.8.1. Providing and administering the Repair Services under the Plan and performing this contract;

11.8.2. Ensuring service quality; and

11.8.3. Communicating with you regarding your Plan, related financial transactions, and Repair Services and support provided under this contract. For such purposes, you agree that this may include the transfer of your personal information between Horys, its affiliates and service providers. If you have any questions regarding the processing of your personal data, contact Horys at

11.9. The terms of the Plan, including the original sales receipt of the Plan and the Plan Confirmation, shall prevail over any conflicting, additional, or other terms of any purchase order or other document, and constitute your and Horys’ entire understanding with respect to the Plan.

11.10. Horys is not obligated to renew this Plan. If Horys does offer to renew this Plan, Horys will determine the price and terms.

11.11. Parties to these terms agree to resolve any disputes promptly and in an efficient manner within thirty (30) days after the dispute arises. In case of failure to reach an amicable solution in an amicable manner, a dispute resolution will be exclusively governed under the laws of the Emirate of Dubai and the relevant Terms and Conditions in this document.

12. GOVERNING LAW AND JURISDICTION

The laws of the Emirate of Dubai govern Plans purchased. Any disputes arising out of or in connection with a Plan purchased, including any question regarding the existence, validity or termination of a Plan or these terms shall be subject to the exclusive jurisdiction of the Emirate of Dubai.
